Recent Public Acts signed into law: P. A. 97-0429 and P. A. 97-0415

On August 16, 2011, the governor signed Senate Bill 2149 (Public Act 97-0429) and House Bill 3334 (Public Act 97-0415) into law.


Executive Summary

  • Public Act 97-0415: Removes two-year limit to apply for a Benefit Protection Leave
  • Public Act 97-0429: Adds non-certified employees of school Finance Oversight Panels to the list of participating employees in IMRF.

The new provisions are explained below.


Public Act 97-0415

Removes two-year limit to apply for a Benefit Protection Leave

Effective date: August 16, 2011

Applies to all active members

Old law: Members who take an authorized IMRF Benefit Protection Leave may receive service credit for up to a maximum of 12 months over their entire career, provided they pay the IMRF member contributions plus applicable interest, and the governing body adopts an authorizing resolution. 

To establish the credits, the member must submit IMRF Form 6.32, IMRF Benefit Protection Leave, before, during or up to two years after the leave period, provided the member is still employed in an IMRF covered position by the same governmental unit.

New law: Removes the two-year time limit to submit an application for an IMRF Benefit Protection Leave. Members can submit the application before, during, or anytime after the leave period, provided the member is still employed in an IMRF covered position.


Public Act 97-0429

Adds non-certified employees of school Finance Oversight Panels to the list of participating employees in IMRF

Effective date: August 16, 2011

Applies to members described below

Old law: Not applicable

New law: Adds non-certified employees of school Finance Oversight Panels to the list of participating employees in IMRF. Requires the school districts served by the panel to be responsible for any liability that remains after a Panel is dissolved.
