WHEREAS, section 7-198 of the Illinois Pension Code authorizes the Board of Trustees of the Illinois Municipal Retirement Fund (IMRF) to establish rules necessary or desirable for the efficient administration of the Fund; and
WHEREAS, section 7-139(a)4 of the Pension Code allows the governing body of an IMRF employer to grant an employee an authorized leave of absence to protect that employee for IMRF pension credit, disability benefits, and death benefits; and
WHEREAS, under sections 7-121, 7-189, and 7-190 of the Pension Code, the IMRF Board of Trustees is the governing body of IMRF and the employer of the IMRF staff and as such has appointed an IMRF authorized Agent; and
WHEREAS, the Board of Trustees has determined that it is appropriate that its duly appointed Authorized Agent be allowed to authorize IMRF Benefit Protection Leaves of Absence for IMRF staff members under the following circumstances:
(a) The staff member would qualify under the federal Family and Medical Leave Act, without regard to that Act’s limits on hours worked or the length of the absence; and
(b) The staff member’s manager agrees to the absence.
NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the Illinois Municipal Retirement Fund does hereby grant to its Authorized Agent the power to authorize a Benefit Protection Leave of Absence for IMRF staff members.
