WHEREAS, Section 1-107 of the Illinois Pension Code permits the indemnification of Trustees and employees of public pension systems; and
WHEREAS, the Board of Trustees of the Illinois Municipal Retirement Fund as permitted by Section 1-107 of the Illinois Pension Code has purchased liability insurance coverage for Trustees and employees; and
WHEREAS, it is deemed desirable to provide indemnification of Trustees and employees to the extent not covered by insurance coverage;
RESOLVED, that the Illinois Municipal Retirement Fund indemnify and protect the Trustees and staff employees against all damages, claims and suits, including defense thereof, when damages are sought for negligent or wrongful acts alleged to have been committed in the scope of employment or under direction of the Trustees; and
FURTHER RESOLVED, that the Trustees and employees shall not be indemnified for willful misconduct or gross negligence.
