Executive Summary

On August 18, 2007, the governor signed House Bill 49 (Public Act 95-0279). Under this new law, legally adopted children are entitled to the same ECO benefits as other children, and no child’s or survivor’s benefit shall be disallowed because the child is an adopted child. This law is effective January 1, 2008.

On August 28, 2007, the governor signed Senate Bill 1380 (Public Act 95-0504). This new law provides a six-month window during which SLEP members may transfer into IMRF service credit they previously earned as a member of the Municipal Employees’ Annuity and Benefit Fund of Chicago. This law is effective immediately


Public Act 95-0504 - Transfer of Chicago service to SLEP
Old law IMRF SLEP members who previously earned service in the Municipal Employees Annuity and Benefit Fund of Chicago cannot transfer that service into IMRF.
New law Provides a six-month window during which IMRF SLEP members can transfer service earned in the Municipal Employees’ Annuity and Benefit Fund of Chicago into IMRF.

To apply for the transfer, the IMRF SLEP member would submit a written request to IMRF no later than February 28, 2008.

The cost to the member for this transfer is the difference between how much money is transferred from the Municipal Employees’ Annuity and Benefit Fund of Chicago to IMRF and the contributions that would have been required had the service been earned in IMRF. (If more money is received than would have been required, no refund is payable.)
Public Act 95-0279 - ECO Child’s Pension
Old law For purposes of eligibility for an ECO Child’s Pension, adopted children are treated the same as natural children if proceedings for adoption began one year before the ECO member’s date of death.
New law Removes the requirement that adoption proceedings must have begun at least one year before the date of death. This change is effective January 1, 2008.
