WHEREAS, Section 139 of the Illinois Pension Code provides that creditable service and credits may be granted for leaves of absence, and the Board of Trustees, in Resolution 7033, established rules and regulation setting forth the requirements therefore, and

WHEREAS, it is desirable that the Board of Trustees, for the direction of the Executive Director and staff, adopt rules and regulations covering the procedures for establishing creditable service and service credit during leaves of absence;

NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees that the following rules and regulations be adopted:

  1. A Leave of Absence Service Credit Authorization shall become effective on the later of the date stated therein or the date filed with the Fund.
  2. A Leave of Absence Service Credit Authorization shall be effective for the period specified therein, but not in excess of the period stated in paragraph 3, and may be extended by the filing of a new Authorization, which shall become effective as of the date it is filed with the Fund.
  3. A leave of absence period may extend for any period authorized by a municipality, but no Leave of Absence Service Credit Authorization shall be effective for more than 12 months leave of absence, and after the employee has been credited with 12 months of service and has been on leave of absence for 12 full months under an Authorization during any further leave of absence with the same or another municipality, he shall be considered by the Fund as an employee who has terminated service. An employee, who has been credited with 12 months service under a Leave of Absence Service Credit Authorization, shall not be credited with any additional credit for leave of absence with another municipality.
  4. An employee receiving service credit under a Leave of Absence Service Credit Authorization shall be considered as a participating employee for the purpose of payment of benefits by the Fund, subject to the limitations of paragraph 5 of this resolution, to the end that:
    1. Upon termination of the leave of absence, he, if otherwise eligible, may draw a retirement annuity without return to active employment.
    2. If disability occurs during the leave of absence, if otherwise eligible, he shall be awarded a disability benefit.
    3. If death occurs during the leave of absence period, the widow of the employee, if otherwise qualified, shall be entitled to a widow's annuity or death benefit, determined as if the death occurred while the employee was in an employment relationship.
    4. If death occurs during the leave of absence period, the beneficiary of the employee shall be entitled to a death benefit determined as if the death occurred while the employee was in an employment relationship.
    5. If death occurs during the leave of absence period, the orphan, or orphans, of the employee, if otherwise qualified, shall be entitled to an orphan's benefit, determined as if the death occurred while the employee was in an employment relationship
  5. An employee may receive service credit under a Leave of Absence Service Credit Authorization at any time, but he shall not qualify for a disability or death benefit unless he has one year of contributing service, other than service under the Authorization, on the date of disability or death.
  6. Notwithstanding the foregoing, the Board will review requests that a Leave of Absence Service Credit Authorization be effective prior to filing with the Fund if:
    1. The employee executed the Authorization prior to, or on, the date it is to be effective.
    2. The delay in filing the Authorization results from good cause, such as inability to present it to the governing body of the municipality prior to the effective date of the Authorization.
    3. The municipality specifically requests that the Authorization be effective prior to the filing date.
