Below are the bills that have been signed into law during the current 97th General Assembly session.

SB 1831

This bill includes the language of HB 1471, HB1956, and HB 3253, all of which were previously signed into law (see below)

Makes several changes to the definition of final rate of earnings and return to work rules.

Also expands the period applicable for the 125% rule, changes the manner in which employer costs are charged and allocated, and requires pension impact statements for certain salary changes.

Suspends the pension of a retired member who returns to work as an independent contractor with the same entity from which he or she retired.

SB 2149

In the provisions applicable to IMRF, this bill would add school Financial Oversight Panels (“FOP”) to the definition of “municipality” in the IMRF Article of the Pension Code and would add certain of their employees to the definition of “employee” for IMRF participation purposes. If the FOP is dissolved, the pension assets and liabilities would revert to the school districts served by the FOP.

HB 3334
  • Grants the Board the authority to deny or terminate disability benefits in certain situations.
  • Removes the two year time limit for benefit protection leaves

HB 1956

This bill makes three changes.

  • Removes the requirement that the Authorized Agent be a member of IMRF in order to be granted authority to vote in employer trustee elections.
  • Allows all annuitants to return to work for an IMRF employer without suspending their pension, as long as they return in a non-participating position.
  • Non-school district employers who joined IMRF after 1/1/1982 will be allowed to choose the 1,000-hour standard.

HB 1471

This bill is effective January 1, 2012. It allows for the employer costs to be allocated between employers when a member retires with multiple IMRF employers by requiring both service credit and salary information to be included in the employer cost calculation.

HB 3332

As amended, temporarily allows IMRF members who have service in a downstate police pension fund to transfer that service to IMRF by paying the total cost or receiving the equivalent amount of service.

HB 3253

Makes two changes: 1) terminate the provision allowing SLEP participants to upgrade non-SLEP service to the SLEP formula for new members and 2) sunset the ECO program
