Pending Illinois Legislation

The 95th General Assembly began on on January 10, 2007. The IMRF Board takes a position (support, oppose, neutral) on bills introduced in the General Assembly.

The Board's position does not directly affect the movement of the bill; the legislation must be passed by theIllinois legislature in order to become law. Read a brief overview of how IMRF legislation is passed.

SB 1957
IMRF proposed legislation.
SB 1957 passed the Senate 51 to 0. It is now in the House.

Gives the IMRF Annuitant Trustee the right to vote.

Increases the number of votes necessary for Board decision or action from four to five.

SB 1958
IMRF proposed legislation.

SB 1958 passed the Senate. It is now in the House.

Provides that separation refunds shall include 3.75% interest (50% of the prescribed rate of interest, currently 7.50%) Senator Clayborne Support
SB 1959
IMRF proposed legislation.
SB 1959 passed the Senate. It is now in the House. 

Stabilizes the 13th Payment at 75% of the monthly pension payable in June preceding the 13th Payment.

Adds the percentage of members' earnings necessary to provide that year's 13th Payment when calculating an employer's contribution rate.

SB 1960
IMRF proposed legislation.

Reduces the vesting requirement for an IMRF pension from 8 to 5 years. Senator Clayborne Support
SB 2003 Provides an alternative retirement annuity for "municipal electrical workers" Senator Haine Oppose
SB 2078 Provides a window for a police officer who transferred service from the Illinois Municipal Retirement Fund or a member of IMRF who transferred service from a pension fund under the Downstate Police Article of the Code under the provisions of Public Act 94-356 may establish additional credit, but only for the amount of the service credit reduction in that transfer. SB 2250 Provides that an elected or appointed coroner may elect to participate in the Fund as a sheriff’s law enforcement employee (SLEP). Allows conversion of prior service. Senator DeLeo Support
SB 2359 Allows a regional council of government that has an Internal Revenue Service ruling that it is a government entity or instrument of government to participate in IMRF. Senator Wilhelmi Support

SB 2627 Creates the Pension Funding and Investments Act. Senator Bomke Neutral
HB 562 Encourages pension funds to promote the economy of Illinois through the use of economic opportunity investments while managing their assets to the greatest extent feasible within the bounds of financial and fiduciary prudence. Representative Bradley, Representative Granberg Oppose
HB 4227 Allows an annuitant to accept employment as a school bus driver without losing ERI benefits or suspending pension payments. Representative Eddy Oppose
HB 4261 Increases the death benefit to $5,000. Representative Poe

HB 4488 Makes park police eligible for the sheriff’s law enforcement employee program formula (SLEP). Representative Sacia Support
HB 4569 Allows an annuitant to re-enter service for a total of 2 years to fill positions vacated because persons are serving on active duty in the military, naval, or air forces of the State or federal government without impairing his or her pension benefits. Representative Brady Oppose
HB 4603 Allows a member seeking transfer of service to IMRF under the Downstate Police Article to pay (based on a formula) and obtain no reduction on the amount of service established. Representative Beiser Neutral
HB 4609 Allows a police dispatcher to transfer service from IMRF to downstate police pension fund Representative Sacia Neutral
HB 4682 Exempts, from the definition of "aggregate extension," contributions to IMRF Representative Moffitt Support
HB 4884 Allows a regional council of government to participate in IMRF, with IRS ruling. Representative Molaro Support
HB 4885 Allows the Will County Governmental League, the West Central Municipal Conference, and the West Cook County Solid Waste Agency to participate in IMRF. Representative Molaro Oppose

HB 5144  Shell bill. Makes a technical change in a Section concerning the purpose of the Illinois Municipal Retirement Fund. Representative Flider Neutral, as introduced
HB 5197 Opens another transfer window between IMRF and police pension funds. The transfer is for up to 8 years of service and the window is until January 1, 2009. Representative Beiser Oppose, as introduced
HB 5244 Shell bill. Makes technical changes in a Section concerning credits and creditable service. Representative Rose Neutral, as introduced
HB 5774 Opens another transfer window between IMRF and police pension funds. Similar to transfer under P.A. 95-530. Includes exception to usual pension recalculation rules for SLEP members who have returned to work and make this transfer. Representative Kosel Oppose
